2008

Apr 12 - The National Center for Missing and Exploited Children (NCMEC) puts Aarys on the missing children list using false information. They state that "Aarys was last seen on November 6, 2006. He may be in the company of his non-custodial father. They are believed to be in Russia. Aarys has a scar under his right eye and a scar under his chin." This is blatantly false. Nov 6 was the date of a PA court hearing, not any date regarding Aarys whereabouts. Aarys was sent by his mother, under specific court order on Aug 30, 2006 to me in Cyprus. Second, it states it in such a way to lead people to believe he was both abducted, and by unknown people. It also states "non-custodial" father, while the only permanent custody order gives me full custody. She only has a temporary order, and it has no jurisdiction. At this point, we stop sending photos to Nancy because we fear she will only use them for wanted posters. NCMEC poster as of Apr 12, 2008

May 7 - The following letter is sent from my Federal Attorney to NCMEC. It informs them that the documentation given to them was in error, and also many other court documents were omitted. Letter

May 29 - NCMEC gives a partial reply to the letter, but basically saying nothing. A reply is also sent.

Jun 6 - NCMEC changes the poster to add Bahrain. It now reads "They are believed to be in Cyprus or Bahrain." Poster as of Jun 6, 2008

Jul 29 - NCMEC responds, but fails to look at UCCJEA or other issues.

Aug 1 - Reply is sent to NCMEC pointing out several errors in their analysis regarding their Jul 29 communication.

2009

Jul 18 - NCMEC poster changes to read "Cyprus or Bahrain".

Issues

NCMEC states in there poster for Aarys:

Aarys was last seen on November 6, 2006. He may be in the company of his father. They are believed to be in Cyprus or Bahrain. Aarys has a scar under his right eye and a scar under his chin.

Missing: Nov 6, 2006
Missing From: Titusville, PA

Aarys was not in Titusville, or even the US on Nov 6, 2006. His passport will clearly show that on Sep 1, 2006 he exited the US in Boston. Here is the ticket information.

How did Aarys leave on Sep 1? By court order of both TN and PA. PA enforced the TN order and explicitly ordered Nancy to transfer him to my parents who would take him to the airport. This transfer occurred Sep 1, 2006 in Erie, PA in a Sam's Club parking lot. Does this sound like a kidnapping to you?

Aarys was escorted the whole way by special airline staff for which I paid extra. Immigration records, flight records, as well as his passport will clearly show that he left via Boston on Sep 1, and entered Cyprus on Sep 2. Then how is it that Aarys supposedly magically appeared back into the US with no passport stamps or immigration? And then magically left the US again without any records? If Aarys was not in the US in Nov 2006, how is it possible that I kidnapped him from the US?

Passport Stamp

This is Aarys passport stamp entering Cyprus. It reads "02.09.06". This is not Feb 9, but Sep 2. It is in European Date format which puts the day first, followed by the month. CY is in the top right and its Cyprus country code. The bottom right reads Larnaka (also spelled Larnaca depending on the translation from Greek) which is city where the main Cyprus airport is. The arrow pointing into a square is the symbol denoting an entry stamp.

Where's Aarys?

NCMEC also states that "may be in the company of his father". It is well established that Aarys is with me, and not some stranger. Nancy knows this and has received many letters from me about Aarys' status, including photographs.

The poster used to read "non-custodial father". Now it reads "father", minus "non-custodial". Is NCMEC changing their story as they go just like the FBI? Or is it that the FBI is getting their story from NCMEC, and disavowing any responsibility for checking the facts?

Magic Nov 6

What is this magical Nov 6, 2006 date that keeps popping up? It was the date of a PA court hearing that never happened.

Why PA?

NCMEC claims the PA orders have precedence. However the child never lived in PA for 6 months legally ever, and was only in PA for summer visitation for less than 3 months (temporary absence from home country by law). TN continues to exert jurisdiction even with full knowledge of PA's attempted actions. I have never been found in violation of the TN orders, while the mother has numerous times. TN is the place she should go to to enforce the TN orders, but refuses to do so. Assuming that both TN and PA are somehow valid. How can NCMEC arbitrarily decide which one is more valid? Both are being enforced by each state. Why is NCMEC taking PA's side when clearly there are conflicting orders?

Furthermore, both TN and PA have statutes that make it clear that other countries are to be treated as states for purposes of custody determinations and jurisdiction. Aarys legally left the US. Aarys lived in a country for far longer than 6 months. So by the law, that country has jurisdiction according to UCCJEA. Definitely not PA.

NCMEC

Most of NCMEC's cases are legitimate. However by persuing a case that they know to be illegitimate and based on false facts they risk losing credibility. This in the end will hurt their mission to find real missing children. Why do they have such a problem with facts in this case?
